I - Terms of Use
- This website belongs to Ivinum, Unipessoal Lda, with headquarters at Rua Professor Mário Chicó, N.º 32 1600-645 Lisboa, NIF 510566693, hereinafter referred to as QonnoisseuR, european brand 018852193, commercial name used on this website. It is also operated and hosted on infrastructure provided by JAVALI – Administração e Desenvolvimento de Sistemas Informáticos, Lda., located at Madan Parque, Rua dos Inventores, Quinta da Torre, 2825-182 Caparica.
- The use of this website is governed by these Terms of Use.
- Are designated by Visitors those who access the website and are not registered on the website.
- Are designated by Users those who access the website and are registered on the website.
II - Acceptance of the Terms of Use
- The user of the website ("User") and the visitor of the website (“Visitor”) acknowledges that by using this website, they accept these Terms of Use.
III - Modification of the Terms of Use
- QonnoisseuR reserves the right to change, add, update, or delete, in whole or in part, these Terms of Use at any time without prior notice and with immediate effect.
- The User and Visitor should periodically check this page for any updates or changes. If the User and Visitor does not agree with any of the rules of use, they should not use the website.
IV - Services
The services provided by Qonnoisseur consist of:
a) Access to the model creation platform to introduce specific and structured data about wines, aromatised wines and alcoholic beverages (“wine pages”) and about the respective producers of wines, aromatised wines and alcoholic beverages (“producer page”)
b) Automatic translation of the information regarding nutritional declaration, ingredients’ list, amongst other information, in the 24 official languages of the European Union.
c) Electronic labels’ creation with information about wines, aromatised wines and alcoholic beverages and about their respective producers of wines, aromatised wines and alcoholic beverages.
d) QR code creation for public access, associated with the electronic labels.
QonnoisseuR does not guarantee that the service provided complies with the European Union's electronic label regulations, and the User is solely responsible for ensuring compliance with the legal requirements for electronic labels.
The generated QR codes and the respective wine pages of the Users will be available for as long as they have an active subscription with QonnoisseuR.
V - Payment and Subscriptions
- Part of the services provided by QonnoisseuR on the website are only available after subscribing to one of the available plans upon payment.
- The payment for the subscription of certain services can be made through any of the methods provided on the website.
- After the payment of the subscription, the User will have access to the subscribed plan for the agreed period of time.
- The User has 14 days to request the cancellation of the subscription and a refund of the amount paid. The request for a refund must be made by email to info@qonnoiseur.wine within the 14 days period right after the subscription. In case of a refund, all the features will be blocked, including all QR codes created. After the 14-day period, the User does not have any right to be refunded.
- The User can subscribe a new plan in their account under the following conditions:
a) If the User subscribes a new plan which has a lower value than the current one, the features of the new plan will only be available at the end of the current plan, regardless the moment when the new plan is subscribed and payed. The option to subscribe to a plan with a lower value than the current one is only available 30 days before the end date of the current plan. When the user subscribes to a plan lower than the current one, they must pay the full price of the new plan.
b) If the User subscribes a new plan which has a higher value than the current one, the User must make the payment of the difference of the plans’ prices. The features of the new plan will be available for use immediately upon payment confirmation, considering that the agreed time period of the current plan remains the same for the new plan. The subscription of a plan with a higher value can be done at any time.
At the end of the term of the current plan, any new plan can be subscribed with higher or lower value than the previous one. If neither a new plan is subscribed nor renovated the current one, the User keeps having access to his account on the website, but with all the features inactive.
IV - Access to the Website
- Qonnoisseur has the exclusive right to suspend, in whole or in part, access to the website at any time, especially for management, maintenance, repair, alteration, or modernization operations, and to permanently or temporarily close the website or any of its services, at any time, at its discretion, without prior notice.
V - Use of the Website
- Users are solely responsible as authors of the content available on the electronic labels, formerly designated as wine pages and producer page.
- The content introduced by Users do not require pre approval from the website to be available to the public, thus QonnoisseuR is not responsible for their verification. The User accepts that QonnoisseuR is allowed to remove at any time, any type of content that is not in compliance with this Terms of Use and Privacy Policy, without prior notice.
- The User acknowledges that QuonnoisseuR does not guarantee the compliance with the Eupoean Union electronic labels’ law and rules of the information inserted by the User. Thus, the User is solely responsible for the omission or non-compliance with the legal requirements of electronic labels.
- The user agrees to provide truthful, correct and objective information when registering on the website, as well as on every other content inserted by them, being responsible for their actions and decisions when using this website.
- It is the User’s responsibility to print correctly the QR code generated generated by the website, as well as the focus on print quality and QR code correct size, in order to guarantee the a correct reading, making the information publicly accessible.
- The use of the website is subject to compliance with the following rules:
a) Do not use the website to send or provide any illegal, false, misleading, threatening, malicious, abusive, defamatory, injurious, invasive of privacy, racial, ethical, or morally reprehensible content, harmful to minors, or content that may negatively affect the image of QonnoisseuR;
b) Do not use the website to send or provide information or content that belongs to third parties and that you do not have the right to use, such as content protected by third-party copyright or content containing personal data of third parties;
c) Do not use the website to provide or transmit any material that may contain viruses, worms, defects, Trojan horses, or other computer items or codes, files, or programs that may interrupt, destroy, or limit the functionality of any computer equipment or communication equipment (hardware or software);
d) Do not use or exploit the website, including its contents, materials, functionalities, or resources, for commercial purposes or in any way that involves payment. This includes promoting or disclosing any brand, product, or service on the website, such as sales offers, sponsorship requests, and contest promotions;
e) Do not remove any copyright notice, trademark, or notices of property rights;
f) Do not impersonate anyone or any entity, including, but not limited to, a representative of QonnoisseuR. Do not guide or receive anyone as if you were a host, nor falsely witness relationships or connections with anyone;
g) Do not provide or transmit any unsolicited or unauthorized content, such as SPAM.
h) Do not collect, store, provide, transmit, exploit, or reproduce information about other users (including usernames and/or email addresses) for unauthorized purposes.
- In general, the User and Visitor must use the website responsibly, prudently, and carefully, avoiding any disruption or degradation of its resources and functionalities. The User and Visitor acknowledges that they use the website at their own risk, being solely responsible for any damage caused to their system and/or computer equipment or other damages or losses, including loss or damage to data, resulting from the use of materials, content, or information obtained through the website in any way.
VI - Intellectual Property Rights
- The User and Visitor acknowledges that the website, its structure and layout, the selection, organization, and presentation of its content, including its functionalities and the software used there in, as well as the trademarks, logos, and symbols displayed on the website, are owned by QonnoisseuR or have been duly licensed to QonnoisseuR.
- The User and Visitor further acknowledges that the contents of this website (texts, images, graphics, sound, animation, and all other information made available) are protected by intellectual property rights, and they agree to respect such rights.
- QonnoisseuR is responsible for managing the design, layout, and arrangement of all information, content, and materials on the website, so QonnoisseuR may, at any time, update, modify, or delete any content, services, options, or functionalities, as well as change their presentation and configuration and alter their respective URLs.
- The User and Visitor is not authorized to transmit, communicate to the public, publish, make available to the public, modify, transform, copy, sell, use, or distribute, in any way, the texts, images, or other information contained on this website or any part of the website without prior written authorization from QonnoisseuR. The use of trademarks and logos on this website, as well as the provision of existing materials and products on the website, does not grant, nor can it be interpreted as granting permission to Users and Visitors to directly or indirectly use such trademarks, logos, or materials.
